February 2022 HOA Minutes

February 21, 2022

Start Time: 6:32 p.m.

Current Business:  Rebekka stated that we did not meet a quorum to reach a vote at the annual HOA meeting in January.  Therefore, we need to take a vote on proposed changes to questions 1 and 2 which are as follows:

Bylaw:

Question 1: PASSED

Article III, Paragraph 4 states: “Annual meeting of the Association shall be held in November or December of each succeeding year.”

Change to: “Annual meeting of the Association shall be held in November, December, or January of each succeeding year.”

Question 2: PASSED

Article IV, Paragraph 7 states: “Should any Director miss three consecutive regular meetings of the Board of Directors, he shall be automatically removed from the Board and a successor selected and approved by the Board to fill his unexpired term.”

Change to: “Should any Director miss three regular meetings in a fiscal year (January – December) of the Board of Directors, he/she shall be automatically removed from the Board and a successor selected and approved by the Board to fill his/her unexpired term.”

Also asked was, “If the Board position misses the first three meetings and is replaced, will they owe prorated dues?  The consensus answer was “Yes”.  There have been issues in the past with Board members missing meetings, so it is needed to clarify the rules in writing.  Brian states that we will/should look at each individual case as it arises.  Both articles were approved.  Everyone in attendance voted on these. 

Other business:  Several of poles are missing or misplaced on the jungle gym.  Misty asked if we think this damage has been done maliciously or just accidentally.  Rebekka states that there is no way to tell.

President/Vice President: 

-The website has been updated to reflect new Board positions.  We are awaiting a quote on fixing the falling fence along Memorial Drive and a quote for replacement.  It is taking forever for the company to respond.  Brandon asked if we could replace this with a plastic looking rock.  Rebekka stated that she is not sure if Superior does this as well.  Depending on bids we might replace just that section or consider replacing the entire wall.  She also reminded all that the next Board Meeting is on Monday, March 21st at 6:30 p.m.

Vice President:  Nothing to report.

Treasurer: 

Brian gave his monthly report and 2022 dues have now been added to it.  As of February 1st, the homeowner balance owed is just over $44,000 with two residents’ bills now over $1,000 with one of those in foreclosure.  Income was just over $53,000; outgoing expenses total almost $5,000 for the month.  The checking balance is at almost $87,000 and savings just over $100,000.  We will need to select which major project/s to accomplish this year at a future meeting of the Board. 

Secretary:  Nothing to report

Pool: 

We need to find a date for the pool opening this year.  Brandon got with John regarding pool chemical costs and found that prices are a little higher but about what they were last year.  They are in plentiful supply this year.  John will send an estimate for services before the next meeting.  Rebekka suggested May 14th, a Saturday for pool opening.  Brandon said that gives us 5 days cushion for anything that can go wrong with pool so it can be fixed and totally prepared. 

-Board voted and agreed 5/14/22 for the pool opening date.

Cabana:

Thane got the parts in for the outdoor box for the phone. 

-The pool sign company is no longer in its old location so Thane will find another company for signs.  Brandon clarified where the original company may have moved and Thane will contact them.  They should only take a day or two to complete.

Landscape: 

We are still looking for someone to do flower beds, etc. at the four entrances.

Social: 

Misty will be planning a pool party, either May 14th or 15th

-The community Easter egg hunt is planned for April 9th.  Misty will get this posted to Facebook. 

Violations: 

Ashley reports that a mini-horse has in fact been acquired by a household across from the pool on Hunter Jackson.  The horse apparently is a disturbance to the neighboring dogs adjacent to the house.  It was stated that some emotional support animals are covered and apparently this is what the owners of the mini-horse are claiming. Ashley will send violations letters to the renter and to the homeowner/landlord to inform them of the livestock rule.  In the letter it is to state their need to get in contact with the HOA and to provide ESA letter/confirmation.  This may fall under the reasonable accommodations law.  Rebekka recommends not going in person to speak to the renters.  The HOA should have the violation and notification in writing.
