March 2019 HOA Meeting Minutes

March 18th, 2019

Attendees: Scott Moss, Kyle Moore, Misty Orr, Heather Finley, Darren Christensen, Brian Bost, Neal Clonts, Julie McGinley, Christi Cherry. Shelly Whiting

Call to order 6:38 pm

Meeting ended 8:00pm

Homeowner Concerns & New Business (Open Forum): 

  • Fines and Assessments were briefly discussed
  • The following answer was provided by legal counsel in regards to the proposed fines and assessments: “As a general rule, if the street is a public right of way, the HOA has no authority to tell someone they cannot park on the street. The street does not belong to the HOA, and it was likely dedicated to the public before the covenants were ever recorded. Covenants can only impose restrictions on property owned by the Declarant when the covenants were originally signed and recorded therefore any item or declaration added after the original inception could be considered in protest (In other words, unenforceable). Lots and lots of covenants have provisions restricting parking on the public streets, but they are generally unenforceable as well. As of this time Oklahoma Law and Oklahoma City Ordinance does not regulate the parking for residential streets other than work or commercial vehicles and those restrictions are only enforceable as it relates to quiet hours. On the trashcans, those are enforceable. On the structures those are enforceable. On the fences, enforcement depends on the plot and covenants.
  • The following fines and assessments are still being considered by the HOA:
    • Proposed Fines & Special Assessments:

Offense Category: Damaged fences (not shared with neighbor).

  • 1st Offense: Warning Letter
    • 2nd Offense: $25.00
    • 3rd Offense: $50.00

Offense Category: Structure violations (Includes; Buildings, Play Equipment Etc.).

All outside structures must submit a letter for approval. Currently documented in the established covenants. All structures built as of 01/01/2017 fall under the grandfather clause. All new structures need to coordinate with the color of the home and have a composite roof. All plans must be submitted to the HOA before permitted to build.

  • 1st Offense: Warning Letter
    • 2nd Offense: $25.00
    • 3rd Offense: $50.00

Offense Category: Trash can violations

All trash cans must be placed as far back as possible from the street during except on designated trash pickup schedules.

  • 1st Offense: Warning Letter
  • 2nd Offense: $25.00
  • 3rd Offense: $50.00

Rezoning Project: 

  • There are no updates at this time. Our Attorney will continue to be placed on retainer for any further actions that might require his assistance.

Social/Welcome

  • HOA Board Members and a few volunteer homeowners stuff eggs with candies for the upcoming Easter Egg Hunt.

Finance

  • Finance report will be provided by the finance committee member.
  • Current attorney fees have not exceeded this initial request presented to our homeowners.

Landscaping

  • Dustin – Asked that if the residents have any area of concern regarding the landscaping to let the HOA know.
